Terms of Service and Dating Service Contract

State right to cancel

RIGHT TO CANCEL: If your billing residence is Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, Rhode Island, or Wisconsin, you may cancel a paid dating service contract without penalty before midnight of the third business day after purchase. Use the refund or billing-help control available for the store that sold the plan and email cancel@namzadapp.com so Namzad can identify and honor any mandatory right. Namzad will return amounts paid under a timely, legally eligible cancellation within the period required by applicable law.

Waheed And Naim LLC, doing business as Namzad, honors all non-waivable state cancellation rights. A cancellation email is effective when received at cancel@namzadapp.com. Applicable state rules determine business-day calculations and refund deadlines. Mandatory rights involving cancellation, death, disability, billing errors, service failure, or another legal exception control over conflicting language in these Terms.

Operator, scope, and agreement

These Terms are an electronic contract between you and Waheed And Naim LLC, doing business as Namzad ("Namzad," "we," "us," or "our"). They apply to the Namzad mobile app, website, APIs, support, and related U.S. dating or matrimonial services.

By creating an account or affirmatively accepting these Terms, you agree to these Terms, the Privacy Notice, Community Standards, Safety Guide, and purchase terms presented to you. If you do not agree, do not create an account, purchase a plan, or use the service.

Eligibility and individual accounts

You must be at least 18, legally able to enter a contract, located in a U.S. market where Namzad is offered, and permitted to use the service under applicable law. The service is for individual adults seeking a relationship or marriage for themselves, not organizations or people acting for another adult.

Each account and profile must belong to the same person. You may create only one account and one profile for yourself. Shared credentials, parent-created or guardian-managed profiles, delegated access, multiple accounts, impersonation, and returning through another account after suspension or a ban are prohibited.

Account accuracy and security

You must provide accurate, current account, profile, identity, and billing information and promptly correct information that becomes inaccurate. You may not misrepresent your identity, age, location, relationship intentions, affiliation, or right to use submitted content.

Keep your password, verification codes, and device access secure; do not allow another person to use your account; and promptly contact support about suspected compromise. You are responsible for activity you authorize, but these Terms do not excuse Namzad from security or consumer-protection obligations imposed by law.

Identity review and no criminal background screening

NAMZAD DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS. Namzad uses Didit as an identity-verification provider to check a government ID, perform biometric liveness and face matching, and analyze fraud signals. Didit's automated result is only one verification control; a Namzad administrator separately reviews profile content before publication. A failed or uncertain verification may be retried, reviewed through support, or handled through an available manual fallback.

Identity review only indicates that submitted evidence appeared consistent with the profile at the time of review. It does not guarantee identity, criminal history, character, intentions, immigration status, relationship status, financial condition, compatibility, or safety.

Nature of the service and member risk

Namzad provides tools for profile discovery, interests, mutual matches, messaging, and optional support. Namzad is not a party to member communications, meetings, relationships, engagements, marriages, transactions, or disputes and does not guarantee that a member is truthful, available, compatible, or safe.

You are responsible for your interactions online and offline. Use independent judgment, follow the Safety Guide, meet in public, protect personal and financial information, never send money to someone you met through Namzad, and contact emergency services when immediate danger exists.

Personal, non-commercial use

Namzad is for personal relationship-seeking use only. Without written permission, you may not use the service for advertising, recruiting, press or media activity, competitor research, lead generation, customer lists, political solicitation, employment solicitation, events, commercial networking, or buying or selling goods or services.

You may not collect member information or contact a member outside Namzad without that member's prior permission. Plans, accounts, access rights, matches, and entitlements are personal and non-transferable.

Acceptable use and API security

You may not scrape, crawl, index, data-mine, bulk-download, mirror, frame, or harvest the service or member data; use bots, scripts, emulators, automated accounts, or unauthorized clients; probe or scan systems; test vulnerabilities without written authorization; bypass authentication, rate limits, access controls, photo restrictions, blocks, moderation, plan limits, or geographic controls; rotate accounts, devices, networks, or identifiers to evade enforcement; or access data or accounts not intended for you.

You may not reverse engineer, decompile, disassemble, alter, inject into, overload, flood, spam, disrupt, introduce malware into, forge requests to, or misuse the app, APIs, infrastructure, or security features. Namzad may rate-limit, block, investigate, preserve evidence, suspend access, and refer suspected unlawful activity to appropriate authorities.

Prohibited conduct

You must follow the Community Standards. Prohibited conduct includes harassment, stalking, threats, assault, coercion, hate, discrimination, doxxing, impersonation, fraud, spam, financial or immigration scams, requests for money, illegal goods, recruiting, prostitution or compensated companionship, sexual exploitation, trafficking, non-consensual intimate content, and content or conduct involving or targeting anyone under 18.

Do not solicit passwords, verification codes, financial credentials, government documents, intimate images, or personal information for an unlawful or exploitative purpose. Respect blocks and requests to stop communicating. Report suspected minors, trafficking, exploitation, credible threats, and urgent safety concerns through available reporting channels or appropriate authorities.

Member content and permissions

You retain ownership of content you submit and represent that it is accurate, lawful, yours, or used with all necessary rights and consent. You are responsible for profile text, photos, messages, reports, support requests, and other content you provide.

You grant Namzad a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, transmit, display, format, moderate, and process your content only as reasonably needed to operate, secure, improve, and enforce the service and comply with law. The license ends when the content is deleted from active systems, except for limited backups, safety evidence, legal holds, audit records, and content retained as described in the Privacy Notice. ID and verification-selfie evidence is subject to the narrower identity-data purposes and retention commitments in the Privacy Notice.

Namzad intellectual property and copyright complaints

Namzad and its licensors own the app, APIs, software, design, branding, trademarks, documentation, and non-member content. Except for the limited right to use the service under these Terms, no rights are transferred to you. You may not copy, modify, sell, sublicense, redistribute, remove notices from, or create derivative products from Namzad technology or content.

Do not upload material that infringes copyright, trademark, privacy, publicity, or other rights. Send a copyright or intellectual-property complaint to privacy@namzadapp.com with identification of the protected work, the challenged material and its location, your contact information, statements of good-faith belief and accuracy, confirmation of your authority to act, and your physical or electronic signature.

Moderation, reports, and enforcement

Namzad may review, restrict, blur, reject, remove, preserve, or disclose content; limit visibility or messaging; investigate reports; require reverification; and warn, suspend, ban, or terminate accounts when reasonably necessary for safety, service integrity, these Terms, or law. A report may preserve relevant conversation context. Blocking stops contact and mutual profile access, while an existing conversation may remain visible as an unavailable-account record.

Namzad does not undertake to monitor every profile, message, meeting, or interaction in real time. We may contact emergency services, safety organizations, or law enforcement when reasonably necessary or legally required. Enforcement decisions may consider available evidence, severity, repetition, evasion, and risk; support may provide an appeal path when appropriate.

Paid plans, renewal, cancellation, and refunds

Immediately before purchase, Namzad identifies the plan and included features, and the Apple App Store or Google Play purchase sheet displays the localized price, access term, billing interval, and renewal terms. Plus and Gold are auto-renewable subscriptions. By confirming, you authorize the store shown in the purchase sheet to charge the displayed amount at the displayed interval until cancellation.

You can manage or cancel automatic renewal from Billing using the subscription-management interface for the store that sold the plan. Cancellation stops future renewal charges while paid benefits remain available through the end of the period already paid for. Account deletion and subscription cancellation are separate. Apple or Google, as applicable, processes Plus and Gold payments, applicable taxes, cancellations, and store refund requests. Plans and entitlements are personal and non-transferable.

Except where the applicable app store, law, or an express purchase disclosure requires otherwise, purchases are final and nonrefundable, and no credit is provided for partially used periods. Billing provides store-specific refund help. Email cancel@namzadapp.com promptly about a statutory cancellation, billing error, unauthorized charge, death, disability, service failure, or another mandatory legal right; the store process and the absence of an in-app outcome do not waive a non-waivable right.

Suspension, deactivation, deletion, and termination

You may deactivate or request deletion in Account settings. Deactivation hides the profile and may be reversible; deletion disables the account and queues data cleanup as described in the Privacy Notice. Namzad may restrict, suspend, or terminate access for violations, safety risk, fraud, nonpayment, legal requirements, or service protection.

Termination does not erase payment obligations, safety evidence, legal holds, or provisions that by their nature survive. The treatment of unused paid access after termination or member-requested closure remains subject to mandatory law and the applicable purchase disclosure; these Terms do not waive non-waivable refund rights.

Service availability, changes, and third parties

Namzad does not guarantee uninterrupted, error-free, or permanently available service. We may maintain, secure, modify, suspend, or discontinue features, but material reductions to already-purchased access remain subject to applicable notice, refund, and consumer-protection obligations.

The service may rely on or link to independent providers such as Supabase, Vercel, Expo, Apple, and Google. Their products and terms may apply to your direct use of them. A link or integration does not mean Namzad controls or endorses all third-party content, and these Terms do not disclaim obligations Namzad retains under law.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAMZAD IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. NAMZAD DOES NOT WARRANT THAT THE SERVICE, MEMBER CONTENT, VERIFICATION, SUGGESTIONS, OR COMMUNICATIONS WILL BE ACCURATE, SECURE, AVAILABLE, OR ERROR-FREE.

Nothing in the service is legal, medical, mental-health, immigration, financial, or other professional advice. Some jurisdictions do not permit particular disclaimers, so they apply only to the extent lawful.

Liability, member disputes, and indemnity

Members are responsible for their own conduct and disputes. To the maximum extent permitted by law, Namzad and its owners, officers, employees, and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Namzad's aggregate liability arising from the service will not exceed the greater of the amount you paid for Namzad through an app store during the 12 months before the claim or $100. These limits do not apply to fraud, willful misconduct, gross negligence, personal injury caused by Namzad, non-waivable consumer rights, or any liability that law does not permit us to limit.

To the extent permitted by law, you will indemnify and hold Namzad harmless from third-party claims, damages, and reasonable costs caused by your unlawful content, infringement of another person's rights, fraud, willful misconduct, or material breach of these Terms. Namzad will provide reasonable notice and allow you to participate in the defense, and this obligation does not reduce defenses or consumer rights that cannot be waived.

Disputes and governing terms

Before filing a non-urgent dispute, email privacy@namzadapp.com with your account email, a description of the issue, and the relief requested, and allow 30 days for a good-faith informal resolution. Either party may seek urgent injunctive relief or use small-claims court without completing that process. We do not require private arbitration or waive either party's right to participate in a class proceeding. Any court proceeding may be brought in a court that has lawful jurisdiction, and applicable law includes the non-waivable law of the state where you primarily reside.

These Terms, the Privacy Notice, Community Standards, Safety Guide, accepted purchase disclosures, and applicable state terms form the entire agreement concerning the service. Invalid provisions are severed; failure to enforce is not a waiver; you may not assign your account or agreement without our consent; we may assign the agreement in connection with a protected reorganization or transfer of the service; neither party is liable for delay caused by events reasonably beyond its control; no agency, employment, partnership, or joint venture is created; and provisions that by their nature should survive termination remain effective. English controls if a translation conflicts, except where applicable law requires otherwise.

Notices, changes, and future features

Namzad may send service, safety, billing, and legal notices electronically to your account or available contact information. Material changes will be presented for renewed acceptance; prior versions and acceptance records are retained. Send contract and cancellation questions to cancel@namzadapp.com and privacy or legal notices to privacy@namzadapp.com.

The current service is U.S.-focused. Identity verification and sensitive-data practices are described in the Privacy Notice. Offering the service in another country may require different terms, notices, controls, or eligibility even if the identity-verification provider technically supports that country's documents.
